Woman Sues Disney for Not Letting Her Ride



ABC 9 is reporting that a Central Florida woman was limited to the number of times she could ride the Tower of Terror even though she had a prescription that said the ride helped her with her abdominal adhesions. Denise Mooty needed several surgeries a year before discovering that riding the ride relieved the pain and cut down the number of surgeries to one a year. She possesses a guest assistance card that allowed her to enter through the Fast Pass lane or the back entrance.

In August, a new manager told Mooty that she was going to be limited to 4 rides and that she would have to use the Fast Pass lane rather than the back entrance. She spent a couple of weeks arguing with Disney’s Hollywood Studios management before being kicked out of the park and receiving citations for trespassing and for using profanity (which she denies). Disney issued a statement that said a restriction was never placed on the number of times Mooty could ride the ride, but she did use profanity in front of guests, leading to the trespassing citation.

Mooty is suing to get back on the Tower of Terror and to collect damages.

My family and I have been Disney fans for years and we are appalled that Disney would treat a disabled woman like that. Shame on Mickey. We will definately be making alternate plans for our spring break next year.

I don’t think all the facts have been given. The woman might have forgotten her card that day and assumed that she would be let in because someone would recognize her.

I agree this was the wrong thing for the manager to do, but I think it’s no reason to STOP going to Disney!

If she wants to ride ToT a lot of times, then she should have to wait like the rest of us. Otherwise I’ll get my doctor to write me a prescription for Toy Story Mania so I can ride it over and over without waiting. Some people are just amazingly difficult.

@appalled Disney fan. I’m appalled you would let the actions of some wacko determine your vacation plans. My mother has the same condition and is a surgical tech and says the ride would not have and effect on the condition. And the woman probably threw a fit because she has a case of “Disney Selfishness” and thinks she is entitled to special treatment. So go enjoy Universal Studios “appalled Disney Fan”, there will be two less people in line infront of me while I enjoy the best theme parks in the world.

Frankly, I’m thrilled that Disney chose to remove a foul mouthed guest. That’s completely inappropriate behavior anywhere….but somehow at Disney it seems especially offensive. Most of us bring our kids to the park to escape the real world….having that ick creep in takes a bit of the magic away, so it’s about time Disney took a stand!

As for her “medical” need……some doctors will write anything (and yeah, they should be accountable for it)….but let’s think about that. Riding Tower of Terror removes scar adhesions in this woman’s stomach? So what is that ride doing to the rest of us???

Should her lawsuit continue, I’m sure that Disney will require some medical experts to examine her and there will also be some medical engineers exploring the validity of her claim….because if it does what she says to her, then it can’t possibly be safe for the rest of us.

Hmmm…..my DH has a hernia, perhaps we can blame it on riding TOT and sue as well?

I have gone to WDW with disabled friends on numerous occasions and have NEVER, not once, seen Disney staff mistreat my friends (and they agree). Other guests…yes, I see that constantly….but not the staff. They are well trained in dealing with a wide variety of medical conditions. The “worst” we’ve had to do is explain what we needed when the CM wasn’t sure how to help….but the offer of help came from her.

Keep up the good work Disney…..treat all your guests like royalty, except the villians, they deserve to be removed!

@ksalase: this is just the media’s version of the story (i.e. the woman’s) Disney hasn’t released any information except that given in the article.

I don’t understand how abdominal adhesions keep her from standing in line like everyone else. If she didn’t need assistance getting to the ride, she doesn’t need backdoor admittance to the ride.

It seems like she was abusing a privilege that she shouldn’t have been given in the first place and the new manager was putting a stop to it. Good for Disney

Hello people, I am the woman who is sueing Disney. I’m sorry for long post here but for those of you who want the facts, please read.
First of all, let me clear up some misgiven information. I do not hold a prescription to ride the ride, the letter from my Doctor was sent to Disney’s exct. office explaining simply how the ride helps me, but by no means is it a prescription. It was sent to disney after the original issue of why the card was revoked in the first place and it was sent only to help Disney to try to understand HOW the ride helps.
As for if I had forgotten my GAC card that day, no I did not, the manager refused to even look at it. The card had just been renewed on 6-28-08 through 9-28-08. After the man from guest services practically accused me of writting on the card, he then went and looked in the computer under my guest service file and saw it was posted that way and that I forged nothing, he revoked the card with no explainion of why!
When I tried to find out why and what did I have to do to get it reinstated, that was when everything went down hill.
Disney chose to eject me under the grounds that I used profanity, because they couldn’t think of any other way to get rid of me.
I have been doing this at Disney for 4 years. 6 mos. of it under the GAC card with NO problems, so why now 1 to 2 weeks after renewing it, did they revoke it? I just wanted to know why and what did I have to do to get it reinstated!
Also, when the head of security told me to leave, I did. It wasn’t until I was at the exit, exiting the park when the head of security told Orange County Sher. Dept. to Tresspass me. By doing so, he was brutal about his methods of handling me. I was in FULL compliance with EVERYTHING Disney was asking of me.
I am not a trouble maker or a foul mouth person.
As for Disney being a family place, in the years I’ve been going there I’ve seen more drunks using profanity and cast members as well. This was nothing more then an excuse for Disney to sweep their mistake under the rug so to speak!!
Because I told them I was going to contact the Vice Pres. and tell them what was going on, it was right after that, that I was ejected.
As for if the ride really helps someone with my condition, YES it does, tremendously!! Until you ride the ride with this condition, you won’t really know!
It’s the G-Forces in both directions that does it!
